Terms of Service

1. Agreement

These terms are an agreement between you and Diaeton ("we", "us"), the operator of diaeton.com. By creating an account or using Diaeton, you agree to them and to our Privacy Policy. If you use Diaeton for a company, you confirm you have the authority to accept these terms on its behalf.

2. Your account

• You must be at least 18 and give accurate information.
• Keep your password safe. You are responsible for activity on your account.
• Tell us straight away at info@diaeton.com if you think your account has been accessed without permission.

3. The service

Diaeton provides AI marketing tools and autonomous AI agents, along with a dashboard, ROI Tracker, CRM, Action Plan and Library. Agents create drafts, plans, tasks and draft campaigns. They do not publish content or spend money on your behalf. We may improve, change or remove features over time.

4. Plans & billing

• Plans: Free, Starter, Growth and Scale, each with monthly limits on agent jobs and AI generations as shown on our pricing page. Unused allowances do not roll over.
• Payment: paid plans are billed monthly in advance through Stripe and renew automatically until you cancel.
• Cancelling: you can cancel any time from the Billing page. Your plan stays active until the end of the paid month, then moves to Free.
• Refunds: [State your refund policy, e.g. "Payments are non-refundable except where the law requires otherwise."]
• Price changes: we will give you at least [30] days' notice before changing the price of your plan.
• Fair use: to keep the service sustainable, each plan includes a fair-use limit on AI processing. If you reach it, AI features pause until your next billing month.
• Taxes: prices exclude taxes unless stated. You pay any applicable taxes.

5. AI output

Diaeton uses artificial intelligence, which can make mistakes, produce outdated information or give advice that doesn't suit your situation. You are responsible for reviewing all output before you use, publish or act on it, including checking claims, prices, legal requirements and advertising platform rules. Comparisons with agency fees and any savings figures are estimates, not guarantees. We don't guarantee any particular marketing result, revenue or return on ad spend.

6. Your content

You own the information you put into Diaeton and, as between you and us, the output generated for you. You give us permission to store and process your content only to provide and improve the service, as described in our Privacy Policy. You confirm you have the right to use any data you upload, including lead and contact details, and that you'll follow applicable marketing, anti-spam and data protection laws when you use it.

7. Acceptable use

You agree not to:

• use Diaeton for anything illegal, deceptive, hateful or harmful, or to create spam or misleading advertising;
• try to break, overload, reverse-engineer or get around the limits or security of the service;
• resell or share access to your account without our written permission;
• use the service to build a competing product.

We may suspend accounts that break these rules.

8. Our property

The Diaeton name, logo, software and website are owned by us and protected by law. These terms don't give you any rights to them except to use the service as intended.

9. Third-party services

Diaeton relies on third parties such as Stripe (payments) and Anthropic (AI processing), and may link to other websites. Their own terms apply, and we aren't responsible for their services.

10. Disclaimers

Diaeton is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and uninterrupted or error-free operation.

11. Liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue, data or advertising spend. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

12. Ending the agreement

You can stop using Diaeton and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, with notice where reasonable. After your account ends, we delete your data as described in our Privacy Policy.

13. Governing law

These terms are governed by the laws of [COUNTRY / STATE]. Disputes will be handled by the courts of [JURISDICTION], unless the law where you live gives you other rights.
